3. Collection and storage of (personal) data as well as type and purpose of their use

SEDLÁK & PARTNER Unternehmensberatung (BDU) GbR operates this survey system independently and on self-hosted and self-managed secure servers in German data centers. Personal data is processed as follows:

a) LogFile data

As a participant in our survey, you will be taken via a link provided for this purpose to a separate survey page of the third-party service provider, on which you can enter your data. When you call up this survey page, information is automatically sent to the server of this website by the browser used on your end device. This information is temporarily stored in a so-called log file. The following information is collected without your intervention and stored on the server until automatic deletion:

  • IP address of the requesting computer (stored in anonymized form)
  • Date and time of access,
  • Name and URL of the retrieved file,
  • The browser used and, if applicable, the operating system of your computer as well as the name of your access provider.

The aforementioned data will be processed for the following purposes:

  • Ensuring a smooth connection of the website,
  • Ensuring a comfortable use of the website,
  • Evaluation of system security and stability, and
  • for other administrative purposes.

The legal basis for the data processing is Art. 6 para. 1 p. 1 lit. f EU GDPR. Our legitimate interest follows from the purposes for data collection listed above. The collected data will not be used for the purpose of drawing conclusions about your person. This data is also not merged with other data.

b) Survey data for "open" surveys

In the context of surveys, we collect answers from you to specific, predefined questions. In the case of so-called "open" surveys, participation is possible without the information provided being assigned to the specific person of the participant (unlike in the case of so-called "closed" surveys, see below). You can therefore answer the questions in the online survey questionnaire without any personal data being processed. Instead, only a statistical survey and subsequent evaluation of subjective information (assessments) about company and industry-related circumstances that cannot be traced back to you is carried out.

However, personal data may of course be processed if you voluntarily provide certain information - for example, in a free text field - on the basis of which you can be identified, or if a reference to a person logically results from certain requested information (for example, if the position you specified is only available once at the stated location).

Even in this case, however, we ourselves will not gain any knowledge of your personal data, as our third-party service provider will only use your information to statistically evaluate it together with the information of all other survey participants and will only transmit it to us in the form of an anonymized report. Our third-party service provider will not use your personal data for any other purpose than to provide us with the aforementioned anonymized report.

Insofar as, in accordance with the above, personal data is processed in relation to the information you have provided, this is based on your voluntarily given consent, Art. 6 Para. 1 sentence 1 lit. a EU GDPR. The purpose of the data processing is the implementation of the respective survey and the identification of relevant findings for the development of the company.

The information you submit is typically deleted in its entirety by our third-party service provider within 30 days of our acceptance of the survey report.

c) Survey data for "closed" surveys

Within the scope of surveys, we collect answers from you to specific, predefined questions. You can only participate in so-called "closed" surveys by means of an access code specially created for you - which is usually already included in a link specially generated for you. Subjective information (assessments) on company and industry-related circumstances is collected and then evaluated. In contrast to generally accessible ("open") surveys, in the case of "closed" surveys our third-party service provider can recognize that you in particular have taken part in the survey and what specific information you have provided. This is due to the fact that we forward certain data about you - solely for the purpose of conducting the respective survey - to our third-party service provider in advance (in particular name, title, company, department, position, function, e-mail, company, age, length of service).

However, even in the case of "closed" surveys, our third-party service provider will only use your personal information (including the data submitted by us) to statistically evaluate it together with the information of all other survey participants and will only transmit it to us in the form of an anonymized report. This means that we ourselves do not receive any information of what you personally answered to certain questions. Our third-party service provider will not use your personal data for any other purpose than to provide us with the aforementioned anonymized report.

In the context of certain surveys, however, you may consent to our third-party service provider transmitting the personal data collected about you to us - in deviation from the above - in a non-anonymized form, so that we can clarify the answers you provide together with you through queries.

The aforementioned processing of personal data is based on your voluntarily given consent, Art. 6 (1) sentence 1 lit. a EU GDPR, or, with regard to the data transmitted in advance by us to the third-party service provider, on our legitimate interest, Art. 6 (1) sentence 1 lit. f EU GDPR. The purpose of the data processing is the implementation of the respective survey and the determination of relevant findings for the development of the company, as well as the exclusion of unauthorized or multiple participations. This is also our legitimate interest in data processing.

The information you submit is typically deleted in its entirety by our third-party service provider within 30 days of our acceptance of the survey report.
 

4. Cookies

Cookies are used on the survey page. These are small files that are automatically created by your browser and stored on your end device (desktop, laptop, tablet, smartphone or similar) when you visit the survey page. Cookies do not cause any damage to your end device, do not contain viruses, Trojans or other malware. Cookies contain characteristic character strings that enable your browser to be uniquely identified when you return to the website. However, this does not mean that we or our third-party service provider will gain direct knowledge of your identity as a result.

The use of cookies serves on the one hand to make the use of the survey page more pleasant for you. So-called session cookies are used on the survey page to recognize that you have already visited individual pages of the website. Session cookies are automatically deleted after you leave the site.

In addition, temporary cookies are also used to optimize user-friendliness, which are stored on your end device for a certain fixed period of time. If you visit the survey page again, it is automatically recognized that you have already been on this page and which entries and settings you have made so that you do not have to enter them again or also to exclude repeated participation in a survey.

On the other hand, cookies are used on the survey page to statistically record the use of the page and to evaluate it for the purpose of optimizing the offer. These cookies make it possible to automatically recognize that you have already been with us when you visit the survey page again. These cookies are automatically deleted after a defined period of time.

The data processed by cookies is necessary for the aforementioned purposes to protect our legitimate interests as well as those of third parties pursuant to Art. 6 (1) p. 1 lit. f EU GDPR.

Most browsers accept cookies automatically. However, you can configure your browser so that no cookies are stored on your computer or a notice always appears before a new cookie is created. Cookies that have already been stored can be deleted at any time. However, the complete deactivation of cookies may mean that you cannot use all the functions of the survey page.
 

5. Disclosure of data

We do not transfer your personal data to third parties for purposes other than those listed below. We will only disclose your personal data to third parties if:

  • you have given us your explicit consent according to Article 6(1), page 1, lit. a, EU GDPR
  • forwarding your data in accordance with Article 6(1), page 1, lit. f, EU GDPR is necessary for the assertion, exercise or defense of legal claims and there are no reasonable grounds to assume that you have an overriding interest worthy of protection in not forwarding your data,
  • there is a legal obligation for disclosure according to Article 6(1), page 1, lit. c, EU GDPR, and
  • insofar as this is permitted by law, and required for the processing of contractual relationships with you according to Article 6(1), page 1, lit. b, EU GDPR
     

6. Data subject rights

If your personal data is processed, you are a data subject within the meaning of the   EU GDPR and you have the following rights against the controller:

Right to information, rectification, restriction of processing, blocking, deletion

Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipient and the purpose of data processing and, if necessary, a right to rectification, restriction of processing, blocking or deletion of this data. For this purpose, as well as for further questions on the subject of personal data, you can contact us at any time at the address given in the imprint.

Right to data portability

You have the right to obtain data that we process automatically on the basis of your consent or in fulfillment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke an already granted consent at any time. For this purpose, an informal communication by e-mail to datenschutz@sedlak-partner.de is sufficient. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

Right of appeal to the competent supervisory authority

In the event of violations of data protection law, the person concerned has the right to lodge a complaint with the competent supervisory authority.     7. Right of objection

    If we process data on the basis of a balance of interests based on Art. 6 (1) lit. F EU GDPR, you have the right toobject to this processing at any time on grounds relating to your particular situation or if it involves direct marketing. In the latter case, you have a general right to object, which will be implemented by us without specifying a particular situation.     8. Data security

    All information that you provide on our survey page is of course transmitted in encrypted form. The widely used SSL procedure (Secure Socket Layer) is used in conjunction with the highest encryption level supported by your browser. As a rule, this is a 256-bit encryption. If your browser does not support 256-bit encryption, 128-bit v3 technology is used instead. You can recognize the encryption by the closed display of the key or lock symbol in the lower status bar of your browser.

    For "closed" surveys, the following also applies:

    In order to ensure the greatest possible security of your personal data, the merging of your data entered online with the personal data transmitted to our third-party service provider takes place on a separate, internal server of the third-party service provider ("offline" and separate from the server used for the online survey).
